{"id":1095,"date":"2025-02-13T15:27:25","date_gmt":"2025-02-13T07:27:25","guid":{"rendered":"https:\/\/cph-legal.com\/?page_id=1095"},"modified":"2026-01-09T17:03:55","modified_gmt":"2026-01-09T09:03:55","slug":"nursing-and-domestic-helper-expesnes-for-injured-children","status":"publish","type":"page","link":"https:\/\/cph-legal.com\/en\/personal-injuries\/traffic-accident-claims\/nursing-and-domestic-helper-expesnes-for-injured-children\/","title":{"rendered":"\u5152\u7ae5\u610f\u5916\u53d7\u50b7 \u8acb\u5de5\u4eba\u59d0\u59d0 (\u4f8b\u5982\u83f2\u50ad)\u7167\u9867\u7684\u958b\u652f\u80fd\u5426\u7d22\u511f\uff1f"},"content":{"rendered":"<p>\u5728\u6d89\u53ca\u758f\u5ffd\u7684\u6c11\u4e8b\u7d22\u511f\u4e2d\uff0c\u539f\u544a\u4eba\u5373\u50b7\u8005\u4e00\u65b9\u6709\u8cac\u4efb\u8b49\u660e\u7167\u9867\u958b\u652f\u662f\u5408\u7406 (Reasonable) \u7684\u3002 <\/p>\n\n\n\n<p>\u5982\u50b7\u8005\u70ba\u5152\u7ae5\uff0c\u800c\u50b7\u52e2\u76f8\u5c0d\u56b4\u91cd\uff0c\u51fa\u9662\u5f8c\u4f9d\u7136\u9700\u8981\u5c08\u4eba\u5f8c\u7e8c\u6301\u7e8c\u7167\u9867\uff0c\u5bb6\u9577\u56e0\u6b64\u8058\u7528\u5de5\u4eba\u59d0\u59d0 (\u5bb6\u5ead\u50ad\u5de5) \u5c08\u9580\u7167\u9867\u5eb7\u5fa9\u4e2d\u7684\u5b50\u5973\uff0c\u5982\u6cd5\u5ead\u8a8d\u70ba\u5408\u7406\uff0c\u76f8\u95dc\u958b\u652f\u53ef\u4ee5\u7d22\u511f\u3002<\/p>\n\n\n\n<p>\u5982\u6709\u5728\u50f1\u50ad\u5408\u7d04\u4e2d\uff0c\u7279\u5225\u5217\u660e\u9700\u8981\u7167\u9867\u53d7\u50b7\u53ca\u6b63\u5728\u5eb7\u5fa9\u7684\u5b50\u5973\uff0c\u4f46\u7121\u9700\u8655\u7406\u5176\u4ed6\u5bb6\u52d9\uff0c\u6b64\u5408\u7d04\u5c07\u4f86\u4ea6\u53ef\u4f5c\u8058\u7528\u5de5\u4eba\u59d0\u59d0\u7684\u5408\u7406\u6027\u7684\u8b49\u64da\u3002<\/p>\n\n\n\n<p>\u5982\u5de5\u4eba\u59d0\u59d0\u540c\u6642\u7167\u9867\u6b63\u5eb7\u5fa9\u7684\u5b50\u5973\uff0c\u540c\u6642\u8655\u7406\u5bb6\u52d9\uff08\u6216\u5176\u4ed6\u8207\u610f\u5916\u53d7\u50b7\u7684\u8b77\u7406\u7121\u95dc\u7684\u5de5\u4f5c\uff09\uff0c\u6cd5\u5ead\u53ef\u5c31\u76f8\u95dc\u958b\u652f\u6709\u6240\u6263\u6e1b\u3002<\/p>\n\n\n\n<p>\u4f8b\u5982\uff0c\u5728Chiu Chung San v Park Sung Jin (DCPI 1124\/2022)\u4e00\u6848\u4e2d\uff0c\u50b7\u8005\u53f3\u773c\u8996\u529b\u56b4\u91cd\u53d7\u640d\uff0c\u6cd5\u5ead\u8003\u616e\u4e86\u50b7\u52e2\u4ee5\u53ca\u91ab\u7642\u8b49\u64da\u5f8c\uff0c\u4e0d\u5141\u8a31\u50b7\u8005\u7d22\u511f\u8058\u7528\u5168\u8077\u5bb6\u5ead\u50ad\u5de5\u7684\u958b\u652f\uff0c\u4f46\u5141\u8a31\u50b7\u8005\u8058\u7528\u517c\u8077\u5bb6\u52d9\u52a9\u7406\u7684\u958b\u652f\uff0c\u70ba\u671f\u4e00\u5e74\uff0c\u76f8\u95dc\u958b\u652f\u7e3d\u984d\u70ba$30,000\u3002<\/p>\n\n\n\n<p>\u6cd5\u5ead\u7684\u7406\u7531\u662f\uff0c\u96d6\u7136\u53f3\u773c\u8996\u529b\u53d7\u640d\u6703\u70ba\u50b7\u8005\u5e36\u4f86\u56b4\u91cd\u4e0d\u4fbf\uff0c\u4f46\u672a\u6709\u5145\u5206\u8b49\u64da\u8b49\u660e\u50b7\u8005\u4e0d\u80fd\u7167\u9867\u81ea\u5df1\u65e5\u5e38\u751f\u6d3b\u6240\u9700\uff0c\u800c\u4e14\u6cd5\u5ead\u4ea6\u8003\u616e\u5230\u50b7\u8005\u9032\u884c\u773c\u90e8\u624b\u8853\u5f8c\u8996\u529b\u61c9\u8a72\u6703\u9010\u6f38\u6062\u5fa9\u3002\u5224\u8a5e\u5982\u4e0b\uff1a<\/p>\n\n\n\n<p>\u201d81.&nbsp;It is understandable that P, with his severely impaired right eye vision, would be greatly inconvenienced in most, if not all, of his daily living activities. There is however, other than his subjective complaints, no medical or expert evidence in support of the claim that he cannot cope with daily living activities or that he is dependent on others for assistance. Expert in ophthalmology Dr Cheung assesses P&nbsp;<em>to have normal (or near-normal) ability to perform activities of daily living<\/em>&nbsp;though&nbsp;<em>with lost reserve capacity.<\/em><\/p>\n\n\n\n<p>82.&nbsp;I consider that on the evidence, a claim for full-time domestic help is not made out. Also, P&#8217;s right eye vision would be expected to improve after the eye operation, after which he should become independent in his daily living.<\/p>\n\n\n\n<p>83.&nbsp;I consider it reasonable to make a provision for part-time domestic help of say once or twice a week for groceries shopping and household cleaning chores, at say $2,000 a month for about a year. I make a lump sum award of $30,000.\u201c<\/p>\n\n\n\n<p>\u81f3\u65bc\u6cd5\u5ead\u5728\u672c\u6848\u4e2d\u662f\u5426\u5c0d\u50b7\u8005\u904e\u65bc\u56b4\u82db\uff0c\u4ee5\u53ca\u50b7\u8005\u65b9\u662f\u5426\u53ef\u4ee5\u6e96\u5099\u66f4\u591a\u5c08\u5bb6\u8b49\u64da\u8b49\u660e\u81ea\u5df1\u8996\u529b\u53d7\u640d\u800c\u96e3\u4ee5\u81ea\u7406\uff0c\u5247\u662f\u53e6\u5916\u7684\u8b70\u984c\u4e86\u3002<\/p>\n\n\n\n<figure
