Wai Nga v Tam Chi Wai\u6848\u88c1\u5b9a\uff0c\u7236\u6bcd\u4e0d\u5c0d\u5b50\u5973\u884c\u70ba\u6709\u8f49\u627f\u8cac\u4efb (vicarious liability\uff09 \uff0c\u5373\u4f7f\u5b50\u5973\u884c\u70ba\u758f\u5ffd\u800c\u5c0d\u4ed6\u4eba\u9020\u6210\u640d\u5931\uff0c\u7236\u6bcd\u4e0d\u4e00\u5b9a\u8981\u8ca0\u8cac\u4efb\uff0c\u9664\u975e\u7236\u6bcd\u5728\u7ba1\u675f\u5b50\u5973\u672c\u8eab\u6709\u758f\u5ffd\u3002<\/p>\n\n\n\n<p>\u7236\u6bcd\u662f\u5426\u758f\u5ffd\uff1f\u6cd5\u5f8b\u539f\u5247\u662f\u7236\u6bcd\u5728\u8003\u616e\u5230\u5b50\u5973\u672c\u8eab\u300c\u6417\u86cb\u300d(meddle) \u7684\u50be\u5411\uff0c\u672a\u6709\u5c0d\u5b50\u5973\u7684\u6d3b\u52d5\u53ef\u9810\u898b\u7522\u751f\u7684\u5371\u96aa\uff0c\u63a1\u53d6\u5408\u7406\u7a0b\u5ea6\u7684\u76e3\u7ba1\u53ca\u63a7\u5236\uff0c\u5c31\u5c6c\u65bc\u758f\u5ffd\u4e86\u3002<\/p>\n\n\n\n<p>\u5728\u9019\u500b\u7db2\u7d61\u71b1\u8a71\u800c\u8a00\uff0c\u7db2\u7d61\u6d41\u50b3\u7684\u5f71\u7247\u986f\u793a\uff0c\u5152\u7ae5\u53ea\u662f\u80cc\u90e8\u8f15\u8f15\u89f8\u78b0\u64fa\u8a2d\uff0c\u64fa\u8a2d\u96a8\u5373\u5931\u5e73\u8861\u5012\u4e0b\u3002\u5982\u679c\u78ba\u662f\u9019\u6a23\u7684\u8a71\uff0c\u5152\u7ae5\u672c\u8eab\u672a\u5fc5\u758f\u5ffd\uff0c\u4ea6\u6c92\u6709\u5728\u300c\u6417\u86cb\u300d\uff0c\u53ef\u80fd\u53ea\u662f\u5e97\u5bb6\u672a\u6709\u59a5\u5584\u56fa\u5b9a\u64fa\u8a2d\u3002\u9019\u6a23\u7684\u8a71\uff0c\u5152\u7ae5\u53ca\u7236\u6bcd\u90fd\u6c92\u6709\u6c11\u4e8b\u8cac\u4efb\uff0c\u7121\u9700\u8ce0\u511f\uff0c\u7236\u6bcd\u5927\u6982\u53ef\u4ee5\u5982\u91cb\u91cd\u8ca0\uff0c\u7b11\u984f\u9010\u958b\u4e86\u3002<\/p>\n\n\n\n<p>\u5f8c\u8a71\uff1a\u5152\u7ae5\u5fc3\u7406\u5065\u5eb7\u662f\u6211\u5f88\u95dc\u6ce8\u7684\u8b70\u984c\u3002\u5c0d\u6210\u5e74\u4eba\u7684\u8aaa\u8a71\uff0c\u8a9e\u6c23\uff0c\u4ee5\u53ca\u52d5\u4f5c\uff0c\u5152\u7ae5\u5bb9\u6613\u4e00\u76f4\u653e\u5728\u5fc3\u88cf\uff0c\u5f71\u97ff\u6df1\u9060\u3002\u80e1\u4e82\u602a\u8cac\u5152\u7ae5\uff0c\u5bb9\u6613\u5c0d\u5152\u7ae5\u9020\u6210\u5fc3\u7406\u5275\u50b7\uff0c\u5e0c\u671b\u5404\u4f4d\u7236\u6bcd\u591a\u52a0\u7559\u610f\u3002\u591a\u9f13\u52f5\uff0c\u5c11\u6307\u8cac\uff0c\u5927\u5bb6\u66f4\u958b\u5fc3\uff0c\u66f4\u70ba\u6709\u6548\u3002
